Terms of Service

By accessing or using the CastOS platform operated by Cast Laboratories Inc. ("Cast Labs," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

CastOS is a cloud-based enterprise resource planning (ERP) platform designed for precast concrete manufacturers. The platform includes modules for estimating, job tracking, production scheduling, dispatch, quality control, inventory, engineering, and financial management, with AI-assisted features integrated throughout.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use. You are responsible for ensuring that users within your organization comply with these terms.

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the platform or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the platform
• Use the platform to store or transmit malicious code
• Resell or sublicense access without our written consent

You retain all ownership rights to the data you input into CastOS. We do not claim ownership of your manufacturing data, documents, or business information. We use your data only to provide and improve the service as described in our Privacy Policy.

You can export your data at any time. Upon termination, we will make your data available for export for 30 days before deletion.

CastOS includes AI-assisted features that process your data to generate suggestions, extractions, and analysis. These features are tools to assist your team - not replacements for professional judgment. AI outputs should be reviewed before acting on them. We are not liable for decisions made based on AI-generated suggestions.

Subscription fees are billed monthly or annually as selected. All fees are non-refundable except where required by law. We may change pricing with 30 days written notice. Failure to pay may result in suspension of access.

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. Unscheduled downtime may occur due to circumstances beyond our control.

To the maximum extent permitted by law, Cast Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from these terms or the platform shall not exceed the fees paid by you in the twelve months preceding the claim.

Either party may terminate the subscription with 30 days written notice. We may suspend or terminate access immediately for material breach of these terms. Upon termination, your right to use the platform ceases. Provisions that by their nature should survive termination will survive.

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Texas.

We may update these terms from time to time. We will notify you of material changes by email or through the platform at least 30 days before they take effect. Continued use after changes constitutes acceptance.
